Fifth Schedule.

(2)

If for any other reason an election is not held

on the appointed day or within the appointed time, or fails

either wholly or in part or becomes void, the Governor may

order an election to be held on a day appointed by him.

(3) If at any time the Council became unable to act,

whether from there being a failure to elect councillors or

a Chairman or otherwise, the Governor may appoint councillors

or a Chairman until the newly-elected councillors or Chairman

come into office.

(4) Where an election is ordered under this section,

notice of the election shall be given, and the election shall

be conducted, in the same manner as is directed by this

Ordinance for the conduct of the election in the place of

which the new election is ordered:

Provided that no fresh nomination shall be necessary in

the case of a candidate who remained validly nominated for

the election which has not been duly held or has failed or

become void.

(5) The cost, if any, of anything done under the

provisions of sub-section (2) of this section shall be paid

by the Council.

(6) If an election of councillors is not held on the

appointed day or within the appointed time, or becomes void,

the Council shall not thereby be dissolved, or be disabled from

acting.

37. Any notice required to be given in connection with

an election held under this Ordinance may relate to more than

one ward or to the whole Municipality and one or more wards.

Meetings and Proceedings.

38. (1) The proceedings of the Council shall be

conducted in the English language and the minutes and records

of the Council shall be kept in that language.

(2) The provisions of the Fifth Schedule of this

Ordinance shall have effect as respects the meetings and

proceedings of the Council and of committees thereof.
